Facts

Respondents appealed that the appeal be struck out for want of prosecution. Appellants Counsel then brought an application for extension of time within which to prepare his record of appeal.

It was discovered that the delay was due to the registrar of the Court of Appeal, who was not aware of the contents of the new Supreme Court rules of 1985, which have completely changed the method of preparing the record of appeal.
